Terms of Service

These Terms of Service ("Terms") set out the conditions for using "サーバー募集掲示板" ("the Service") provided by Hakki Kai ("the Operator"). By using the Service, you are deemed to have agreed to these Terms.
Article 1 (What the Service is)
1. The Service is a bulletin board where game server operators post listings to recruit streamers, and streamers apply to them.
2. The Operator is not a party to any listing, application, or communication between users. The Operator bears no responsibility for whether a listing or application succeeds, or for any trouble that follows.
3. Any arrangements between a recruiter and an applicant (participation conditions, whether payment is involved, streaming conditions, and so on) are made between those parties.
4. Where the game a listing is for, or what takes place on the server, carries an age restriction, only people who meet that restriction may apply or take part. Recruiters must state any such age restriction in the listing (in the requirements).
Article 2 (Eligibility and accounts)
1. Logging in to the Service requires a Discord account. People who do not meet the minimum age set by Discord's terms of service may not use the Service.
2. If you are a minor, please use the Service with the consent of a parent or guardian.
3. Your account is for your own use. You may not lend, transfer, or share it.
4. You are responsible for managing your account. Actions taken through your account are treated as your own.
5. If it becomes clear that an account was registered with a false age or other false details, the Operator may suspend or delete it.
Article 3 (Prohibited conduct)
The following are prohibited when using the Service:
・Anything that breaks the law or public order and morals
・Posting listings or applications containing false information
・Fraud, improper demands for money, or solicitation
・Defamation of other users, discriminatory expression, or posting someone's personal information without permission
・Posting sexual or violent content in anything shown on the Service (a listing's title, body, requirements, images, and the like)
・Listings intended for activity that breaks a game's own terms (cheating, modifications, and the like)
・Spam, unrelated advertising, or repeated posting of the same content
・Interfering with the operation of the Service, unauthorised access, or excessive automated access
・Impersonating someone else
・Using information about an applicant, learned through an application, for any purpose other than screening and communication about that listing, or providing it to a third party
・Asking applicants for personal information beyond what screening requires (address, phone number, legal name, identity documents, and the like)
・Filing false reports, or repeatedly filing removal requests without grounds
Article 4 (Handling of posted content)
1. Copyright in listings, applications, images, and other content posted by a user remains with the person who posted it.
2. By posting, you confirm that you hold the rights needed for that content and that it does not infringe the rights of others.
3. The Operator may use posted content free of charge to the extent needed to provide and display the Service, to allow indexing by search engines, and to generate images for sharing on social media.
4. The Operator may hide or delete any post judged to breach these Terms, without prior notice. When a post is hidden, the reason is shown to the person who posted it.
Article 5 (Reports)
1. If you find a listing that breaches these Terms, you can notify the Operator using the report form on the listing page.
2. Reporting requires you to be logged in. Only the Operator can see the contents of a report.
3. Listings are never hidden automatically based on the number of reports. The Operator decides.
4. The Operator is not obliged to reply individually to a reporter about the outcome of a report.
Article 6 (Automatically Collected Listing Information)
1. Where a listing includes a Discord server invite link, the Operator retrieves the invite information published by Discord and displays the server's creation date and approximate member count on the listing page.
2. Only information that anyone holding the invite link could obtain is retrieved. Member lists and personal information inside the server are never retrieved.
3. The Operator does not guarantee the accuracy of this information, and does not use these figures to decide whether a listing is permitted.
Article 7 (Reporting the Outcome)
1. After a certain period has passed since a listing's deadline, the Operator may ask the listing owner and approved applicants to report whether the server actually went ahead.
2. The reporting status and result ("Confirmed held", "Cancelled", "Outcome not reported" and so on) are shown on the Service. Who answered what is not shown.
3. Where a user has a certain number of listings whose outcome has not been reported, the Operator may prevent that user from creating new listings. The restriction is lifted as soon as the report is submitted.
4. The restriction in the preceding paragraph is separate from the suspension of use in the following Article and does not mean the user has breached these Terms.
5. The Operator may ask listing owners to report, as an optional item, whether any approved applicant failed to take part. Such records are shown only as a count, and only on the review screen of an owner to whose listing that applicant has applied. They are never shown to other users.
6. Users can view their own records on My Page. If a record is inaccurate, they may say so through the contact form, and the Operator may revoke it after checking.
Article 8 (Suspension of use)
1. If a user breaches these Terms, the Operator may suspend the account or delete posts without prior notice.
2. The Operator is not responsible for any disadvantage caused to the user by such measures.
Article 9 (Leaving the Service)
1. You can delete your account at any time from My Page.
2. What happens to your data on deletion is described in the "If you delete your account" section of the Privacy Policy.
Article 10 (Changes to and suspension of the Service)
1. The Operator may change the content of the Service, and may suspend or end it.
2. If the Service is to be discontinued, the Operator will give notice on the Service or by other means at least 30 days before the closing date. This does not apply where circumstances make it unavoidable, such as disaster, system failure, or a change in the law.
3. The notice period above does not apply to temporary maintenance or outages caused by failures. Notice will be given in advance where possible.
Article 11 (Paid features)
1. The Operator may in future offer parts of the Service for a fee, or display advertising.
2. If paid features are offered, their content, pricing, payment methods, and cancellation conditions will be set out separately, together with the disclosure required under the Act on Specified Commercial Transactions.
3. All features currently offered are free of charge.
Article 12 (Disclaimer)
1. The Service is provided as is. The Operator does not warrant that its content is accurate, complete, useful, or fit for any particular purpose, nor that the Service will be free from interruptions, errors, or defects.
2. The Operator is not responsible for disputes between users, or between a user and a third party.
3. The Operator is not responsible for the content of links posted by users (Discord servers, streaming channels, and so on).
4. Notwithstanding the three paragraphs above, the Operator is responsible for damage caused to a user by the Operator's intent or gross negligence.
5. Where the Operator is liable for damages other than in the case above, that liability is limited to direct damage ordinarily arising from the Operator's act, and does not extend to lost profits or damage arising from special circumstances.
Article 13 (Changes to these Terms)
1. The Operator may change these Terms.
2. The Operator may do so without individual consent where the change is in the general interest of users, or where it does not conflict with the purpose of the Service and is reasonable in light of the need for the change and the appropriateness of its content.
3. For changes that significantly affect users, the Operator will announce the revised content and its effective date on the Service at least 30 days in advance. Other changes take effect when posted on this page.
Article 14 (How we contact each other)
1. The Operator contacts users by display within the Service, by Discord direct message, or by sending email to the address registered by the user.
2. Users should contact the Operator through the contact form.
Article 15 (No assignment)
You may not assign your position under these Terms, or any rights or obligations under them, to a third party, or offer them as security, without the Operator's prior written consent.
Article 16 (Severability)
If any provision of these Terms, or part of one, is held invalid or unenforceable, the remainder continues in full effect.
Article 17 (Governing law and jurisdiction)
1. These Terms are governed by and construed in accordance with the laws of Japan.
2. Any dispute between the Operator and a user concerning these Terms or the Service is subject to the exclusive jurisdiction of the District Court having jurisdiction over the Operator's place of residence as the court of first instance.
